(07058690) and is based at GREEN ROOM, 122 LAVENDER HILL, LONDON, ENGLAND SW11 5RB and provides a service to our users ("User" "You" "Your"hereafter). By visiting this website you agree to be bound by these terms and conditions of use. Please read these terms and conditions ("Terms" "Terms and Conditions" "Terms of Use" hereafter) carefully as failure to comply may result in criminal or civil proceedings against you. We reserve the right to change our terms at any time, and the changes will be effective immediately after they are posted here. It's your responsibility to check these regularly, and continuing to use the service after revised terms have been posted here constitutes your consent to amended terms and your agreement to abide by the revised terms of use.
Responsibilities
The Platform
Crashpadder.com is an online venue which facilitates the sharing and exchange of information between Users. Users can also elect to meet and stay with one another. We are in no way involved in meetings between Users which occur outside the Site.
Accuracy of information
We make no attempt to verify the identity of or the accuracy of information provided by Users on Our Site. You are solely responsible for ascertaining the identity and appropriateness of other Users of the Site and it is strongly encouraged that you do so prior to meeting other Users. This should be done by communicating directly via the Site and via their profile, feedback and other information on the Site. At no time will We investigate a User's background, conduct, reputation or information which they provide to the Site.
Use of the Service
We take no responsibility for harm which may come to Users as a result of use of Our Service. Users have sole responsibility for all interactions with other Users, whether on Site or face-to-face. We reserve the right to monitor all interactions between Users which are carried out on the Site in order to restrict any behaviour we deem to be inappropriate, or which contravene these Terms. Any action which we deem to be obscene, aggressive, in contravention of these Terms or in any other way inappropriate will result in Users' accounts being restricted or permanently closed without forewarning. We may alter or remove any aspect of our service at any time and at our sole discretion.
Release
In using Our Service you agree to absolve Crashpadder UK Ltd from responsibility for any harm which may come to you as a result of using the Service. You agree that any compensation which you may seek for harm which comes to you as a result of using the service will not be sought from Us, but rather from the other User or Users. You agree not to seek any legal remedy or damages whether actual, consequential, nominal, punitive, nor otherwise nor impose liability on Us, Our staff, officers, directors, representatives, commercial partners or agents. By using the Site you indemnify and hold harmless Crashpadder UK Ltd., Our staff, officers, directors, representatives, commercial partners or agents for any negative experience which arises from Your use of the Site.
Conduct
By using the site, you agree to behave responsibly and not to: i)Violate any law, regulation, contractual obligation or court order, ii) Infringe on the rights of any person, business, group, entity or violate any copyright, patent, trademark, trade secret, or other proprietary right or right of publicity or privacy, iii) Interfere with or damage the Site including viruses, worms, Trojan horses, or other programmes, scripts or software intended to do harm to the Site or other Users, iv) Use our services to distribute any commercial information other than that pertaining to a booking via the Site or post links to third-party websites where accommodation can be searched for, booked or enquired about, v) Post any accommodation which you do not rent, own or have legitimate legal right to rent to other Users on a short-term basis vi) Hold more than one user account, vii) Post false information about You, Your accommodation, Your identity or personality on the Site, viii) Make private arrangements to transact with, meet, stay with or otherwise interact with other Users except via the Site in the manner described, ix) Submit any information which is inaccurate, misleading or false.
By accepting a booking request on the Site at the price specified by You are accepting a legal offer and entering into a legally binding contract with the other User. The price cannot be altered after this offer is accepted.
Disputes
You are solely responsible for the resolution of disputes with other Users which have arisen as a result of or in connection with User of the Site or Service. We reserve the right to monitor the communication between Users undergoing the process of dispute resolution with impartiality.
Minors
By registering with Crashpadder.com you are confirming that you are over the age of 18. Minors may not use this Service.
Your content
By submitting all or any content (including any photographs, videos, words, or pictures) to our Site, you grant us a perpetual, worldwide, non-exclusive, royalty-free license to use, reproduce, display, edit, sell, distribute, have distributed such content in any form, in all media now known or hereinafter created and for any purpose, subject to the Privacy Policy as described in Section 4. In using the Site you offer guarantee that You have sufficient rights to grant us this license.
We have no obligation to post content submitted by You for display on the Site. In addition We may edit or delete any content that you submit without warning and for any reason.
We do not control, and shall have no responsibility for, Third-Party Content, including material that may be unlawful, misleading, incomplete, erroneous, offensive, indecent or otherwise objectionable which You come into contact with as a result of or in connection with use of our Service.
Payment and fees
We charge Users a small fee for use of the Service. By using the Service as a guest you agree to pay the amount posted by the host, either in full via the website, or in cleared funds or cash on arrival, or a combination of these. By using the service as a host you agree to pay 10% of the total amount charged to the guest for the stay to Crashpadder UK Ltd.
Making a booking. As a guest you are required to complete a booking request via the Site. The host will then accept or reject your request. When you make the booking request You will be required to submit either credit card, debit card or Paypal account details and we will pre-authorise your account for the full booking amount. If the host accepts your booking request the money will be captured and kept in our bank account. We will transfer money owed to the host within 7 days of your departure from the property, and often on the day of your arrival.
Cancellation charges
If a guest cancels a booking, the following cancellation fees will apply:
More than 48 hours notice: Booking fee + 10%
24-48 hours notice: booking fee + 25%
Less than 24 hours notice: booking fee + 50%
You agree that that Users are solely responsible for determining tax reporting requirements in consultation with tax advisors, and that we cannot and do not offer tax advice to either hosts or guests.
Proporietary rights
Material on our Site is protected by rights of publicity, copyright, trademark, trade secret, and other proprietary rights and intellectual property laws as applicable. You may not sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish or create derivative works from such material except when you have demonstrable consent from Us. "Crashpadder" and "Crashpadder.com" are trademarks of Crashpadder UK Ltd and are protected law; you agree not to use such marks for any purpose, including but not limited to as metatags on other websites.
You may not systematically retrieve data or other content from our Site to create or compile, directly or indirectly, in single or multiple downloads, a collection, compilation, database, directory or the like, whether by manual methods, through the use of bots, crawlers, or spiders, or otherwise. You may not display any portion of our Site in a frame (or any content from our Site through in-line links) without demonstrable consent, which may be requested by contacting us.
Your login details
You will, during the registration process, select a username and password. You are solely responsible for the confidentiality of your username and password. You are responsible for logging off the Site at the end of each session. You agree to notify us immediately of any use of your username and password or any other breach of security which you suspect to be unauthorised.
Right to terminate
We reserve the right to terminate Your access to the Site, deactivate or delete your account and all related information and files associated with your account or restrict or otherwise limit your access to any such files and Services at any time and at our sole and unfettered discretion.
Local Law
You agree to use our Services in a manner consistent with any and all local, national and international laws and regulations.
Reporting misconduct
If you stay with or host anyone who you feel is acting or has acted inappropriately you must immediately report such person to the appropriate authorities and then to us provided that your report shall not obligate us to take any action beyond that required by law (if any) or cause us to incur any liability to you.

IF YOU USE OUR SERVICES, YOU DO SO AT YOUR SOLE RISK. YOU ACKNOWLEDGE AND AGREE THAT CRASHPADDER UK LTD DOES NOT CHECK ANY GUEST, HOST, OR OTHER USER'S BACKGROUND OR RECORD. Crashpadder.com IS A REPUTATION-BASED SYSTEM. PLEASE TAKE ADVANTAGE OF OTHER USER'S COMMENTS AND THIRD-PARTY REFERRALS ON HOSTS AND GUESTS. USE COMMON SENSE. BE AWARE AND BE SAFE. OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS AND WITHOUT ANY WARRANTIES OF ANY KIND. WE EXPRESSLY DISCLAIM, AND YOU WAIVE, ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. No warranty or guarantee will be created by information obtained by You or Transmitted to you which contradicts, adds to or alters those guarantees and warrantees laid out in these terms.
We shall not be liable for damages or compensation of any kind even if informed of the possibility of such damages which arise from the use of our Service including but not limited to: damage to You or Your property, loss or disclosure of your information or submitted content, harm cause to You as a result of using the service, or by third parties who you have come into contact with as a result of using our service.
We are not liable for any failure to deliver the Service as described when the failure is due to factors beyond our control including, but not limited to, acts of nature and power, or lack of internet or email access.
In no event will our liability to you or a third party as a result of or in connection with use of the Site exceed 100 GPB.
These Terms contain the entire agreement, and supersede all prior and contemporaneous understandings between the parties. Our failure or delay in exercising any right, power or privilege under these Terms shall not constitute as a waiver of said right. The invalidity or unenforceability of any of these Terms shall not affect the validity or enforceability of any other of these Terms. We may assign our rights and delegate our obligations under these Terms in whole or part to a third party. Your continued use of this Site and registration to use our Services is contingent upon your agreement to be bound by the foregoing Terms of Use.
Refunds
If a guest arrives to find accommodation inaccurately described and would like a refund they must inform Crashpadder by email within 24 hours of arriving at the property, explaining why they are dissatisfied. The host will then have 7 days to appeal this refund request. If no appeal is received the guest's money will be refunded in full.
Promotional Codes
We may from time to time offer promotional discount codes, which may apply in respect of any, or certain specified, bookings made though the Crashpadder.com website. Promotional discount codes are only available to verified Crashpadder members. Crashpadder members may only use one promotional discount per booking. We reserve to right to cancel promotional codes at any time without reason.
